In attorney discipline cases, a mitigating factor for sanctions is whether the respondent-attorney made timely good-faith efforts to make restitution or to make up for the misconduct. George Mahaffey explains in his latest piece here --> https://hubs.li/Q02xh_r-0

The most common violations for which disbarment is a potential consequence stem from mishandling client funds and intentional misrepresentations. A good preventative system is the best way to avoid an encounter with the disciplinary system. - Craig Brodsky in The Daily Record https://hubs.li/Q02xfvmX0 #legalethics

One effect of the COVID-19 pandemic has been a change in jurors' attitudes towards scientific evidence, experts, and institutions. Jurors are more skeptical—and sometimes even hostile—to broadly accepted scientific principles and mainstream scientists. In this piece, Carrie Williams and Derek Stikeleather examine why the pandemic has given rise to what we have called “QAnon Jurors,” how to spot them, and how, if at all, to persuade them. https://hubs.li/Q02wB7Lv0

The National Labor Relations Board has declared broadly worded confidentiality, non-disclosure, and non-disparagement clauses unlawful in severance agreements with employees, leaving employers with little guidance on the extent to which they can restrict departing employees from disclosing separation terms. Goodell DeVries's Nichole Nesbitt will speak on these issues at The Trial Network's Sun, Surf, and Strategies conference this week. She will explain the policy justification for the new prohibitions as well as the linguistic pitfalls and semantic safe zones for employers' revised agreements. https://hubs.li/Q02vmMWJ0
